Terms of Service

These Terms of Service ("Terms") govern your use of mossvale.net and any website, application, API, or service operated under the mossvale.net domain or its subdomains, including services that may be added in the future (collectively, the "Services"). The Services are operated by an individual developer ("we," "us," "the operator"). By using any of the Services, you agree to these Terms.

1. The Services

The Services are independently developed software projects made available on an ongoing basis. Not every Service requires an account; some do. Features, availability, and scope of any Service may change or be discontinued at any time without notice.

2. Accounts

Where a Service requires an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly if you suspect unauthorized use of your account.

3. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to any Service, other users' accounts, or the systems and networks the Services run on.
• Interfere with or disrupt the integrity or performance of any Service (including by overwhelming it with automated traffic).
• Reverse engineer, decompile, or extract source code from a Service except where applicable law expressly permits it.
• Copy, redistribute, resell, or create derivative works from a Service or its content without prior written permission (see Section 4).

We may suspend or terminate access to any Service, for any account, at our discretion, including for suspected violation of these Terms.

4. Intellectual Property

All software, source code, design, text, graphics, and other content that make up the Services are the property of the operator (or used under license) and are protected by applicable copyright, trademark, and other intellectual property laws. Except for whatever rights are expressly granted to you to use a given Service as intended, no part of the Services may be copied, modified, distributed, sold, or used to create a competing or derivative product without prior written permission.

Any feedback, suggestions, or ideas you submit about a Service may be used by us without obligation to you.

5. Third-Party Services

Some Services rely on third-party infrastructure or sign-in providers (for example, content delivery, hosting, or "Sign in with Google") to operate. Your use of those third-party integrations is also subject to that third party's own terms and privacy practices.

6. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DATA WILL NEVER BE LOST.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, THE OPERATOR'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES IS LIMITED TO THE AMOUNT (IF ANY) YOU PAID TO USE THE RELEVANT SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so some of the above may not apply to you.

8. Indemnification

You agree to indemnify and hold the operator harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of a Service after an update constitutes acceptance of the revised Terms. Material changes will be reflected by updating the "Last updated" date above.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which the operator resides, without regard to conflict-of-law principles, except where applicable law requires otherwise.
